Delve-Saarthi™ Privacy Policy

This Privacy Policy (this “Policy”) describes how Delve Solutions (“Delve Solutions”, “we”, “us”, “our”) collects, uses, shares and protects personal data and other information in connection with the Delve-Saarthi platform: the Delve-Saarthi CRM mobile application and the web applications Delve-Saarthi CRM, Delve-AAdesh, Delve-Sampada HR and Delve-Sarahana Review (together, the "App").

Delve-Saarthi is an enterprise platform supplied to pharmaceutical companies. It is not available for public sign-up, and is used only by employees and authorised field personnel of our client organisations, to whom login credentials are issued by their employer. Your employer's use of the App is governed by the Delve-Saarthi Terms and Conditions of Use, Version 2.0; this Policy describes the same roles, security, retention and breach measures as those Terms. In the event of any inconsistency between this Policy and those Terms as they apply between Delve Solutions and your Employer, those Terms shall prevail.

1. Our role and your employer's role

Where you use Delve-Saarthi as an employee or authorised representative of a pharmaceutical company (your "Employer"), your Employer determines what data is collected through the App and why. Under India's Digital Personal Data Protection Act, 2023, your Employer acts as the Data Fiduciary and Delve Solutions acts as a Data Processor, processing personal data solely on your Employer's documented instructions. In equivalent terms under other laws, your Employer is the data controller and we are the processor.

Your use of the App is also governed by your Employer's own privacy notice and field-force policies. Requests to access, correct or erase your personal data shall be addressed to your Employer in the first instance, and we shall assist your Employer in fulfilling them.

2. Information we collect

This information is provided to us by your Employer or entered by an administrator; it is not collected from the public.

The App collects the approximate and precise location of your device only at the moment you mark attendance or submit a call report, in order to record where a field activity took place and to help your Employer verify field coverage. Location is collected only while the App is open and in use. The App does not collect location in the background, does not track your movement continuously, and does not collect location when the App is closed.

You may deny or revoke the location permission in your device settings. If you do, you can continue to use the App, but your Employer may require a location-tagged report and the submission may be recorded as incomplete.

2.4 Photographs

Where your Employer enables it, the App records a photograph you take when you mark attendance (a selfie) or as proof of a visit. Photographs are taken only when you choose to take them in the App; the App does not access your photo gallery or camera at any other time.

2.5 Information about doctors, chemists and other healthcare professionals

The App stores business-contact and professional information about healthcare professionals and retail chemists, including name, qualification or speciality, clinic or shop name and address, contact number, and prescription and stocking observations recorded during RCPA activity. This information is entered by App users acting on behalf of, and under the instructions of, their Employer, who is responsible for the lawfulness of its collection and for any notice or consent required from those individuals. Delve Solutions processes this information solely to provide the App to that Employer. The App is not designed to hold patient records, and health data about identified patients must not be entered.

We do not sell, rent or share any personal data with any third party for that party's own purposes. We do not use App data for advertising or cross-context behavioural advertising, to train artificial-intelligence or machine-learning models, whether our own or a third party's, or to supply data brokers.

We do not use personal data for our own marketing. An Employer may be named as a user of the App, by its name and logo, as permitted by, and subject to the right to object under, clause 24.7 of the Delve-Saarthi™ Terms and Conditions of Use. Any other reference to an Employer's use of the App in marketing material, such as a case study, testimonial or industry statistic, shall be made only with that Employer's prior written consent, and only using aggregated or anonymised information from which no individual user, healthcare professional or chemist can be identified.

5. Data retention, backups and recovery

We retain data for as long as your Employer's subscription is active. Upon termination or expiry of the subscription, your Employer's data shall remain available for export for thirty (30) days, following which we shall delete it from our production systems within a further thirty (30) days, save where we are required by law to retain records for legal, tax or audit purposes.

We back up the production database every day and retain each backup for seven (7) days; accordingly, deleted data is removed from our backups within seven (7) days of its deletion. If a disaster renders the App unavailable, we aim to restore it within seventy-two (72) hours with no more than twenty-four (24) hours of data lost. These are operating targets and not guarantees.

6. Account and data deletion

Because Delve-Saarthi accounts are created and controlled by your Employer, individual users cannot delete their own account from within the App.

To request deletion of your account and associated personal data:

We shall acknowledge each request within five (5) business days and, upon confirmation of the request by your Employer, shall delete your account credentials, profile and device identifiers within thirty (30) days. Field activity records that belong to your Employer as business records (call reports, RCPA data, tour plans) may be retained by your Employer in de-identified or archived form where they are required for statutory, audit or business-continuity purposes; we act on your Employer's instruction in this respect.

7. Security

No system is perfectly secure. If we confirm a personal data breach affecting your personal data, we shall notify your Employer without undue delay and in any event within seventy-two (72) hours, so as to enable your Employer to inform you and the Data Protection Board of India as required by law.

Subject to applicable law, and routed through your Employer as Data Fiduciary, you may:

9. Children

Delve-Saarthi is an enterprise workplace application intended solely for adult employees and authorised personnel of our client organisations. It is not directed at children, and we do not knowingly collect personal data from anyone under 18 years of age.

10. International transfers

Our primary hosting is located in India. Where a service provider processes personal data outside India, we shall ensure that the transfer is permitted under applicable law and is subject to appropriate contractual safeguards.

11. Changes to this policy

We may update this Policy from time to time. The “Last updated” date at the top of this page indicates the most recent revision. Material changes shall be communicated to our client organisations, which shall inform their users. We shall keep this Policy consistent with the Delve-Saarthi Terms and Conditions of Use whenever either is updated.
